Proposed Tree Law -- Public Hearing October 4, 2023


The Town Board will conduct a public hearing on a proposed revision to the Town’s Tree Law on October 4th.   The proposed law seeks to balance the dual goals of preserving the Town’s tree canopy and our residents’ right to fully enjoy their properties.

The law will require residents to apply for a permit to take down those trees on their property that are healthy and have a diameter of six inches or more.  Except for brand new construction on a vacant parcel, there will be a limit on the number of trees that can be removed from a lot during any twelve-month period.  The limit will depend upon the size of the lot. 

Another positive element, added to the Tree Law by this proposed law, is that persons removing trees will be required to replace them with new trees on their property.  In some situations this will result in two or even three new trees replacing each one removed.

For those properties where new trees cannot be planted, owners will be required to pay into the Town’s tree fund.  These payments will be used to purchase trees to be planted elsewhere in the Town.

The Town’s overall tree canopy will be preserved and even enhanced as the new trees mature.

There also will be a one-year hiatus between successive tree permits so if one reaches the maximum number of trees that can be removed in one year, that person cannot obtain a permit to cut down more trees in the very next year.

The Town Board encourages your comments whether they be in favor or against the proposed law.  You may address the Board personally at the public hearing which will occur at 8:00 pm on October 4th in the Courtroom of the Town Center, 740 West Boston Post Road, 2nd floor or you may write to the Supervisor at the Town Center or email her at supervisor@TownofMamaroneckNY.org.  All written and electronic comments will be distributed to the members of the Town Board and become part of the public record.
